COMMONWEALTH v. Admiral SUTHERLAND.


MEMORANDUM AND ORDER PURSUANT TO RULE 1:28

The defendant appeals from an order of a single justice of this court denying his motion to reinstate his consolidated appeals, which were dismissed for lack of prosecution after the defendant's attorney failed to file a brief. The Commonwealth does not oppose reinstatement of the defendant's appeals.

The defendant filed a direct appeal from his convictions and a separate appeal from the denial of his motion for new trial, and the two appeals were consolidated.

Having reviewed the defendant's brief and the authorities cited, and given the lack of opposition, we vacate the order dismissing his consolidated appeals. The clerk shall reinstate the consolidated appeals and set the case for briefing.

So ordered.
