MEMORANDUM AND ORDER PURSUANT TO RULE 1:28

The defendant, Jose Perez, filed a motion to revise and revoke years after his convictions of a litany of serious criminal charges. Given that his motion was not filed within the mandated sixty-day time limit, it was properly denied. See Mass.R.Crim.P. 29(a), 378 Mass. 899 (1979); Commonwealth v. Fenton F., 442 Mass. 31, 36 (2004).

Even if we were to consider, which we do not, the merits of the motion, the defendant would fare no better for the reasons set forth in the brief of the Commonwealth at pages 16 through 19.

Order denying motion to revise and revoke affirmed.
