The defendant's conviction of assault and battery by means of a dangerous weapon is reversed, and that verdict is set aside. Judgment shall enter upon so much of the indictment as alleges the lesser included offense of assault and battery upon Roger Cornell. The case is remanded to the Superior Court for resentencing on that offense.
