I. The Court of Appeals erred in finding that Minitee sufficiently preserved the issue of double jeopardy for appeal.

II. The Court of Appeals erred in determining that the trial judge abused his discretion by declaring a mistrial.

III. If this Honorable Court finds that the Court of Appeals erred in finding a violation of Mr. Minitee's double jeopardy rights, then the Court of Appeals also erred in refusing to rule on Mr. Minitee's remaining assignments of error regarding the violation of his speedy trial right, and the trial judge's refusal to recuse himself.
