The guilty verdict on that portion of complaint no. 9721CR0058 charging the defendant with operating under the influence is vacated and that portion of the complaint shall be dismissed. The judgment on the third offense portion of complaint no. 9721CR0316 is vacated and the matter is remanded for resentencing. The judgment of conviction of driving to endanger is affirmed.
