Indictment charging defendant with receiving stolen goods. Before GATES, P.J., specially presiding, without a jury. Appeal No. 178, Oct. T., 1970, from judgment of sentence of Court of Common Pleas, Trial Division, of Philadelphia, June T., 1968, No. 377. Argued March 18, 1970.

Francis S. Wright, Assistant Defender, with him Melvin Dildine, Assistant Defender, and Vincent J. Ziccardi, Acting Defender, for appellant; James D. Crawford, Assistant District Attorney, with him Arlen Specter, District Attorney, for Commonwealth, appellee.


The district attorney being in agreement, the judgment of sentence is reversed, and the defendant is discharged.
