The judgment on the indictment charging kidnapping is vacated, the verdict is set aside, and the indictment is to be dismissed. As to the convictions of aggravated rape and armed robbery, the verdicts shall stand, but the sentences are vacated and the matter is remanded for resentencing consistent with the memorandum and order of the Appeals Court.
