That portion of the order on the defendant's motion for new trial vacating the conviction on the charge of assault and battery by means of a dangerous weapon and placing the conviction on file is modified to provide that the judgment is reversed and the finding set aside. As so modified, the order on the defendant's motion for new trial is affirmed.
