Appeal from summary conviction before a magistrate for violation of The Vehicle Code. Before BELL, J. Defendant found guilty of summary offense of speeding and judgment of sentence entered. Defendant appealed. Appeal, No. 577, April T., 1976, from Court of Common Pleas of Washington County, No. G105949 of 1975. Argued November 15, 1976.

Kirby Lee Boring, with him Donald L. Phillips, for appellant; Walter W. Gregory, Jr., Assistant District Attorney, and Jess D. Costa, District Attorney, submitted a brief for Commonwealth, appellee.


Because it appears that the Commonwealth's witness was unsworn, the case is remanded to the court below for a proper hearing.
