Appeal, No. 298, Jan. T., 1970, from order of Court of Common Pleas, Trial Division, of Philadelphia, June T., 1948, No. 89, in case of Commonwealth of Pennsylvania v. John Fleming a/k/a James A. Fleming. Order affirmed.

Proceeding under Post Conviction Hearing Act.

Petition denied, order by REIMEL, J. Defendant appealed.
