MEMORANDUM AND ORDER PURSUANT TO RULE 1:28

The defendant was convicted, by a jury, of criminal trespass. He was acquitted of resisting arrest and assault and battery on a police officer. The defendant appeals, claiming (1) insufficiency of the evidence, (2) ineffective assistance of counsel, and (3) failure of the judge, sua sponte, to instruct the jury as to certain exceptions to the criminal trespass statute.

For the reasons cited in the brief of the Commonwealth at pages seven through fifteen, we affirm.

Judgment affirmed.
