Appellate review denied.
The request is denied without prejudice. The case is remanded to the Appeals Court for consideration of an issue that was raised by the defendant in his Appeals Court brief but apparently not decided by the Appeals Court, namely: whether the prosecutor improperly and unfairly exploited the judge's ruling excluding the defendant's third-party culprit evidence. Either side may apply (or reapply, as the case may be) for further review after the Appeals Court considers and decides that issue.
