Indictment charging defendant with illegal possession of drugs. Before O'NEILL, J., without a jury. Appeal, No. 639, Oct. T., 1970, from judgment of sentence of Court of Common Pleas, Trial Division, of Philadelphia, April T., 1969, No. 484. Argued June 11, 1970.

John W. Packel, Assistant Defender, with him Vincent J. Ziccardi, Acting Defender, for appellant; James D. Crawford, Deputy District Attorney, with him Arlen Specter, District Attorney, for Commonwealth, appellee.


The district attorney being in agreement with appellant's position, the judgment of sentence is reversed, and a new trial granted.
