Indictments charging defendant with larceny, receiving stolen goods, conspiracy, and burglary. Before REIMEL, J., without a jury. Appeal, No. 1419, Oct. T., 1969, from order of Court of Common Pleas, Trial Division, of Philadelphia, March T., 1965, No. 1395, opinion by SMITH, JR., J. Submitted December 8, 1969. Austin J. McGreal, for appellant; James D. Crawford, Assistant District Attorney, and Arlen Specter, District Attorney, for Commonwealth, appellee.


OPINION PER CURIAM: The judgment of sentence is reversed and a new trial is granted, in the interest of justice, the district attorney being in agreement. See Commonwealth v. Bostick, 215 Pa. Super. 488, 258 A.2d 872.
