Indictment charging defendant with manufacturing, delivering or possession with intent to manufacture or deliver a controlled substance. Before HALBERT, J., without a jury. Finding of guilty and defendant's motion in arrest of judgment granted. Commonwealth appealed to the Superior Court, which reversed the order of the lower court and remanded the case for sentencing. Judgment of sentence entered. Defendant appealed. Appeal, No. 565, Oct. T., 1977, from Court of Common Pleas, Trial Division, of Philadelphia, Oct. T., 1973, No. 1947, and Jan. T., 1974, No. 129. Argued March 20, 1978.
