Appeal, No. 464, Jan. T., 1969, from order of Superior Court, No. 562, Oct. T., 1968, reversing order of Court of Quarter Sessions of Philadelphia County, Aug. T., 1967, No. 228, in case of Commonwealth v. Noah Altizer. Order of Superior Court affirmed.

Same case in Superior Court: 213 Pa. Super. 201.

Indictment charging defendant with receiving stolen goods. Before NIX, JR., J.

Verdict of guilty; defendant's motion for new trial granted. Commonwealth appealed to the Superior Court, which reversed the order of the court below. Appeal by defendant to Supreme Court allowed.

The Court being equally divided, the order of the Superior Court is affirmed.
