Indictment charging defendant with robbery, aggravated assault, attempt with intent to commit a criminal homicide and conspiracy. Before ACKER, J. Appeal, No. 439, April T., 1974, from judgment of sentence of Court of Common Pleas of Mercer County, Dec. T., 1973, No. 39.
