ORDER


AND NOW, this 14th day of January, 2009, the Application for Leave to File Original Process and the Petition for Writ of Mandamus are GRANTED. The Court of Common Pleas of Dauphin County is directed to examine Judge Lewis' August 24, 2005 order and determine what further action needs to be taken with respect to Petitioner's May of 2005 Motion for Exhaustion of State Remedies/Federal Remedies. See CP-22-CR-0000180-1988. The Court of Common Pleas of Dauphin County shall issue an order with respect to Judge Lewis' August 24, 2005 order and Petitioner's Motion for Exhaustion of State Remedies/Federal Remedies within 90 days of the entry of our order.

Finally, Petitioner's request that this Court stay all proceedings is DENIED.
