Indictment charging defendant with aggravated assault, simple assault and possession of an instrument of crime generally. Before TROMMER, J. Finding of guilty following guilty plea and judgment of sentence entered. Defendant appealed to Superior Court, which remanded case to court below to allow defendant to petition to withdraw his guilty plea, nunc pro tunc. Order entered denying petition, opinion by MIRARCHI, Jr., J. Defendant appealed. Appeal, No. 805, Oct. T., 1977, from Court of Common Pleas, Trial Division, of Philadelphia, Oct. T., 1975, No. 2134. Argued September 20, 1977.
