ORDER
Defendant McNichols failed to appear at the preliminary pretrial conference held on June 7, 2006, and was ordered to show cause why his default should not be entered. Doc. No. 17. Although defendant was expressly advised that his failure to do so would result in the entry of his default and of final injunctive relief, defendant has nevertheless made no response.
The Court concludes that defendant has abandoned the defense of the litigation. The Clerk is DIRECTED to enter defendant's default. Moreover, the preliminary injunction previously entered in this case is made final. Defendant is ENJOINED from taking any further actions designed to deny plaintiff and its employees access to pipeline no. SRW 9592, Well. no. 9507 and Rectifier no. BS 24 so that plaintiff can perform the necessary maintenance and testing procedures.
The Clerk shall mail a copy of this order and the final judgment in this case to defendant, by both regular and certified mail.
