Nathan Colson, Petitioner(s) v. Office of the Public Defender, Fifteenth Judicial Circuit, Respondent(s)

Lower Tribunal No(s).: 4D19-3122; 062018CF000204A88810.

Because Petitioner has failed to show a clear legal right to the relief requested, he is not entitled to mandamus relief. Accordingly, the petition for writ of mandamus is hereby denied. See Huffman v. State, 813 So.2d 10, 11 (Fla. 2000).

The Court hereby retains jurisdiction to pursue any possible sanctions. See Fla. R. App. P. 9.410(a) (Sanctions; Court's Motion). Petitioner is hereby directed to show cause on or before June 8, 2023, why, pursuant to section 944.279(1), Florida Statutes (2020), a certified copy of the Court's findings should not be forwarded to the appropriate institution for disciplinary procedures pursuant to the rules of the Florida Department of Corrections as provided in section 944.09, Florida Statutes (2020).

CANADY, LABARGA, COURIEL, GROSSHANS, and FRANCIS, JJ., concur.
