MEMORANDUM OPINION
By letter dated December 12, 2008, the Court notified appellant that his brief was overdue. We directed appellant to file his brief and an extension motion within ten days or the appeal would be dismissed. To date, appellant has not tendered a brief or filed an extension motion. Accordingly, we dismiss the appeal. See Tex. R. App. P. 38.8(a).
