Colby v. Wynne

Appellate Division of the Supreme Court of New York, Fourth Department
Jan 1, 1933
238 App. Div. 763 (N.Y. App. Div. 1933)

Opinion

January, 1933.

Judgment and order affirmed, with costs. All concur, except Sears, P.J., and Crosby, J., who dissent and vote for reversal on the facts and for granting a new trial on the grounds, first, that the wrong measure of damages was adopted, and second, that the damages were grossly excessive upon any theory.
