ORDER MODIFYING OPINION AND

DENYING PETITION FOR REHEARING [No Change in Judgment]

GOOD CAUSE appearing, the opinion filed February 2, 2012, in the above entitled matter is hereby modified as follows:

1. On page 9, line 20, the last sentence of the second full paragraph which reads "We therefore hold that there was substantial evidence to support the administrative finding that use of the claimable cost line is allowed under the applicable Medicaid regulations, and that the Department did not abuse its discretion by doing so."

Should be deleted and replaced with the following sentence:

"We therefore hold that there was substantial evidence to support the administrative finding that use of the claimable cost line is allowed under the applicable Medicaid regulations, and that the Department did not abuse its discretion by doing so at this stage of the process."
