CHASE ANDREW CLOWER, Appellant v. THE STATE OF TEXAS, Appellee

From the County Court at Law Navarro County, Texas Trial Court Nos. C41046-CR and C41048-CR

Before Chief Justice Gray, Justice Johnson, and Justice Smith

ABATEMENT ORDER

PER CURIAM

The reporter's record in No. 10-23-00013-CR was filed with this Court on March 2, 2023, and the reporter's record in No. 10-23-00014-CR was filed with this Court on March 29, 2023. However, in both appeals, State's Exhibit 34, the dashcam video of Navarro County Sheriff's Deputy Rick Jameson, is not viewable by this Court. Furthermore, in both appeals, State's Exhibit 136, a photo, is missing from the exhibit volume of the reporter's record.

Accordingly, these appeals are ABATED to the trial court to, within 21 days from the date of this Order, oversee the filing of a copy of State's Exhibit 34 in a format that is viewable after it has been uploaded/filed via the clerk/reporter portal into this Court's case management software, a.k.a. TAMES. If this is functionally impractical to accomplish, then the trial court is ordered to oversee the transfer of State's Exhibit 34 to a format that is viewable on any modern DVD player or computer drive without any other proprietary software.

Additionally, the court reporter is ORDERED to, within 21 days from the date of this Order, file in each of these appeals a corrected exhibit volume that contains State's Exhibit 136.
