NOAH LEE CLOUSE, Appellant, v. THE STATE OF TEXAS, Appellee.

Do not publish. Tex.R.App.P. 47.2(b).

ON APPEAL FROM THE 36TH DISTRICT COURT OF ARANSAS COUNTY, TEXAS

Before Chief Justice Contreras and Justices Longoria and Peña

ORDER

PER CURIAM

This cause is before the Court on appellant's fourth motion for extension of time to file appellant's brief. Appellant's brief was originally due on December 15, 2023. After three previous extensions, appellant's brief was due to be filed on March 18, 2024. On March 1, 2024, the Clerk of the Court sent appellant notice that no further extensions would be granted absent new and exigent circumstances.

However, the Court, having fully examined and considered appellant's fourth motion for extension of time to file the brief and the extensions previously granted in this cause, is of the opinion that, in the interest of justice, appellant's fourth motion for extension of time to file the brief should be granted by order.

IT IS THEREFORE ORDERED that the Honorable Diamond DeLeon, counsel for appellant, file the appellate brief with this Court on or before 5:00 p.m. on April 17, 2024. If the Honorable Diamond DeLeon fails to file the brief as ordered, a show cause hearing shall be set.
