ORDERED as follows:
(1) The Recommendation is ADOPTED;
(2) The Motion to Proceed In Forma Pauperis (Doc. 9) is DENIED;
(3) This case is DISMISSED without prejudice prior to service of process.
The Clerk is DIRECTED to terminate all pending motions.
