This case is calendared for trial at the Atlanta, Georgia Trial Session of the Court scheduled to commence on November 27, 2023.
On October 27, 2023, docket entry 9, petitioner filed a Motion for Continuance. By Order dated October 27, 2023, docket entry 10, the Court directed respondent, on or before November 3, 2023, to file a response to Petitioner's Motion for Continuance, filed October 27, 2023, docket entry 9.
On November 3, 2023, docket entry 12, respondent filed a Response to Petitioner's Motion for Continuance which indicates that a basis for settlement has been reached that resolves all issues in the case, but the parties are awaiting computations that reflect the basis for settlement. Because the parties require additional time to file an executed decision with the Court, respondent's counsel does not object to the granting of petitioner's motion for continuance of trial.
After due consideration, it is ORDERED that jurisdiction of this case is retained by this Division of the Court. It is further
ORDERED that petitioner's Motion for Continuance, filed October 27, 2023, docket entry 9, is granted, in that this case is stricken for trial from the November 27, 2023, Atlanta, Georgia Trial Session of the Court, and this case is continued. It is further
ORDERED that, on or before January 8, 2024, the parties shall submit decision documents or file a Joint Status Report (or, if that is not possible, then separate reports) with the Court as to the then-present status of this case.
