Order Per Curiam

The Honorable Gregory T. Perkes, former Justice of this Court, did not participate in this decision because his term of office expired on December 31, 2016. In accordance with the appellate rules, he was replaced on panel by Justice Hinojosa. See TEX. R. APP. P. 41.1(a).

This cause is before the Court on appellant's motion for rehearing. This Court previously issued a memorandum opinion dismissing this cause of action. See Clark v. Blanco, No. 13-16-00478-CV, 2017 WL ___, at *___ (Tex. App.—Corpus Christi Dec. 21, 2016, no pet.) (mem. op. per curiam). The Court, having fully examined and considered appellant's motion for rehearing, is of the opinion that, in the interests of justice, appellant's motion for rehearing should be granted. Accordingly, we withdraw our previous opinion and judgment. Said cause remains pending before the Court.

It is so ORDERED.
