ORDER


On August 9, 2002, the Order, Report and Recommendation (Docket No. 98) executed by Chief United States Magistrate Judge Larry M. Boyle, was entered on the court docket along with a clerk's certificate of mailing. However, it has been brought to the Court's attention that a clerical error has occurred and that the parties did not receive a copy of the Order, Report and Recommendation as indicated on the clerk's certificate of mailing.

THEREFORE, IT IS HEREBY ORDERED as follows:

1. The Clerk of the Court is directed to serve copy of the Order, Report and Recommedation (Docket No. 98) on all parties.

2. Written objections to the Report and Recommendation must be filed within ten (10) days of the date of this Order, pursuant to 28 U.S.C. § 636(b)(1) and Local Rule 72.1(d) or as a result that party may waive the right to raise factual and/or legal objections in the Ninth Circuit Court of Appeals.

3. The Court Trial scheduled on September 10, 2002, shall be VACATED pending a ruling on the Order, Report and Recommendation.
