QUIETING TITLE, § 6title in plaintiff, evidence. In action by chuch to restrain defendant from evicting it, and to remove cloud on title, plaintiff did not show title in itself entitling it to contest cloud on title, where plaintiff's agreement with owner stated that church trustees had received of church officers part of the down payment, and that when down payment was made a contract for a warranty deed would be issued, as this did not convey any interest in the property to plaintiff.

Appeal from Superior Court of Cook county; Hon. DONALD S. MCKINLAY, presiding.

Affirmed. Heard in first division, first district, this court at October term, 1940.
