Appellate Division of the Supreme Court of New York, Fourth Department

279 App. Div. 1133 (N.Y. App. Div. 1952)

Opinion

May 7, 1952.

Present — Taylor, P.J., McCurn, Vaughan, Kimball and Wheeler,

Resettled order insofar as appealed from modified by directing payment of counsel fees to plaintiff rather than plaintiff's attorney and, as so modified, affirmed, with $10 costs and disbursements to respondent, on the ground that it cannot be said that the Special Term improperly exercised its discretion in awarding $200 counsel fees to the respondent wife, where the only question before us is whether the Special Term, upon a disputed question as to the financial status of the respondent, properly exercised its discretion. All concur. (Appeal from part of a resettled order allowing plaintiff counsel fees in a separation action.)
