City v. Scovel

Utah Court of Appeals
Aug 8, 2002
2002 UT App. 265 (Utah Ct. App. 2002)

Opinion

Case No. 20020477-CA.

Filed August 8, 2002. (Not For Official Publication)

Appeal from the Third District, Sandy Department, The Honorable Denise P. Lindberg.

Benjamin A. Hamilton, Salt Lake City, for Appellant.

Lynda R. Krause, Sandy, for Appellee.

Before Judges Davis, Greenwood, and Orme.

MEMORANDUM DECISION

This case is before the court on a sua sponte motion for summary dismissal for lack of jurisdiction. See Utah R. App. P. 10(a)(1). Defendant seeks to appeal the district court's judgment rendered on April 30, 2002.

The district court docket records a minute entry indicating that the court sentenced Defendant on April 30, 2002. However, the record does not contain a signed minute entry or any other signed order of judgment and sentence entered by the district court in this case. Because the record does not contain a signed final order, this court is without jurisdiction over the appeal. See Utah R. App. P. 3(a); State v. Crowley, 737 P.2d 198 (Utah 1987) ("An unsigned minute entry does not constitute a final order for purposes of appeal.").

Accordingly, we grant the sua sponte motion and dismiss the appeal for lack of jurisdiction.

Pamela T. Greenwood, Judge, Gregory K. Orme, Judge.
