City of Shreveport v. Shaffer

Supreme Court of Louisiana
Apr 9, 1979
369 So. 2d 1353 (La. 1979)

Opinion

No. 64241.

April 9, 1979.

In re Ernest W. Shaffer, Jr. applying for remedial writ. Caddo Parish. City Court of Shreveport. T-5319.

Writ denied. Unlike the case on which relator relies, City of New Orleans v. Lyons, 342 So.2d 196, the Shreveport ordinance under which relator was prosecuted is a "fighting words" breach of the peace statute. See Chaplinsky v. New Hampshire, 315 U.S. 568, 62 S.Ct. 766, 86 L.Ed. 1031 (1942) as reaffirmed in Gooding v. Wilson, 405 U.S. 518, 92 S.Ct. 1103, 31 L.Ed.2d 408.
