Opinion

December 20, 1961

In an action to foreclose a tax lien on premises in the City of Mount Vernon, New York, the defendant, The Foundation for Orphans in Greece, Inc., appeals from an order of the Supreme Court, Westchester County, dated March 21, 1961, which permitted the Official Referee to amend the findings of fact and the judgment of foreclosure by correcting an error in the description of the premises so as to conform to the property actually held by said defendant; and which authorized the sale of the premises described in the judgment as amended. Order affirmed, with $10 costs and disbursements. No opinion. Beldock, Ughetta, Kleinfeld and Christ, JJ., concur; Nolan, P.J., concurs on the sole ground that the appellant is not aggrieved by the order.
