CITY OF HOUSTON, ET AL., Appellants v. HOUSTON MUNICIPAL EMPLOYEE PENSION SYSTEM, Appellee CITY OF HOUSTON, ET AL., Relators

On Appeal from the 333rd District Court Harris County, Texas
Trial Court Cause Nos. 2015-35252 and 2015-35252A ORIGINAL PROCEEDING WRIT OF MANDAMUS
333rd District Court Harris County, Texas
Trial Court Cause Nos. 2015-35252 and 2015-35252A

ORDER

Relators City of Houston, et al., filed a petition for writ of mandamus complaining of a severance order and a judgment, which remains pending in this court under case number 14-19-00142-CV.

Relators also filed a motion for temporary relief, asking this court to (1) stay all proceedings in the severed action still pending in the trial court and (2) stay relators' direct appeal from the judgment and orders in the underlying action (our case number 14-18-00896-CV). See Tex. R. App. P. 52.8(b), 52.10.

We DENY relators' motion for temporary relief.

PER CURIAM Panel consists of Chief Justice Frost and Justices Jewell and Bourliot. (Chief Justice Frost dissents to this order to the extent that the court denies a stay of all proceedings in the severed action. Chief Justice Frost would grant a stay of all proceedings in the severed action while the mandamus petition is pending to protect this court's jurisdiction by maintaining the status quo of underlying proceeding while the court considers the merits of original proceeding. See Tex. R. App. P. 52.10).
