From Kosciusko Circuit Court; Lemuel W. Royse, Judge.

Petition to the Public Service Commission by R.R. Smith as receiver of the Chicago, South Bend and Northern Indiana Railway Company to be permitted to abandon the local street-car service in the city of Goshen, which opposed the granting of the petition. The petition was denied, and an appeal was taken to the Elkhart Circuit Court, from which it was venued to the Kosciusko Circuit Court, which granted appellee's petition. From this order, the city of Goshen appealed. Affirmed. By the court in banc.
