Civil Action 01-D-766-N
July 5, 2001
Glenn E. Glover, Scott Wells Ford, Johnston, Barton, Procter Powell, Birmingham, AL, for plaintiff.
CM Mach. Corp., Pro Se.
ORDER
The court has carefully reviewed Plaintiff's Complaint and finds that Plaintiff has not met his burden of showing that there is federal subject matter jurisdiction over this civil action.
Among other things, the Complaint raises no federal question, does not invoke the court's diversity jurisdiction, and does not identify the citizenship of the parties. "The requirements of the jurisdictional statutes are not procedural niceties. They reflect the careful judgment of Congress, and courts have no authority to disregard such legislation out of some vague notion of expediency or fairness." Ellis v. Huttig Bldg. Prods., Inc., 141 F. Supp.2d 1070, 1072 (M.D. Ala. 2001) (DeMent, J.).
Accordingly, it is CONSIDERED and ORDERED that this case be and the same is hereby DISMISSED WITHOUT PREJUDICE. The Clerk of Court shall close this case.
