Frank Ciolli Petitioner v. Commissioner of Internal Revenue Respondent

ORDER

Mark V. Holmes Judge

This case was on the Court's October 19, 2020 trial calendar for New York City. The parties had earlier reported that they had settled, but that petitioner needed some time to marshal the cash he needs to pay. Those funds are now in escrow and will be heading to the IRS soon. Once the payment appears in respondent's transcript system, respondent plans to file a motion to dismiss this CDP case as moot. It is therefore

ORDERED that on or before February 7, 2022 respondent move to dismiss the case as moot or file a joint status report to describe their progress.
