ORDER

Before the Court is Defendant's motion to dismiss for lack of subject matter jurisdiction. Plaintiffs failed to oppose the motion and, on May 5, 2004, this Court issued an order to show cause within ten (10) days why Defendant's motion should not be granted. Plaintiffs have not responded to that order. The Court therefore grants Defendant's motion to dismiss with prejudice pursuant to DUCivR 7-1(d).

IT IS SO ORDERED.
