ALI CHOUDHRI; DALIO HOLDINGS I, LLC; AND DALIO HOLDINGS II, LLC; Appellants v. MOKARAM-LATIF WEST LOOP, LTD. AND ALI MOKARAM, Appellees

On Appeal from the 333rd District Court Harris County, Texas Trial Court Cause No. 2012-27197-A

Panel Consists of Chief Justice Christopher and Justices Hassan and Poissant.

ORDER

PER CURIAM.

This appeal is brought pursuant to Tex.R.Civ.P. 76a (8) and complains of the trial court's order denying appellants' motion to seal, signed October 6, 2021. In its order, the trial court granted a limited stay until October 20, 20201, to permit appellants an opportunity to appeal the order and seek a stay pending the appeal. On October 12, 2021, appellants' filed an emergency motion for expedited relief seeking a stay of the trial court's order denying the motion to seal. A response was requested and filed by appellees.

We grant the motion and temporarily stay enforcement of the trial court's October 6, 2021 order denying appellants' motion to seal court records, pending final decision by this court in this interlocutory appeal or further order of this Court. See Dallas Morning News v. Fifth Court of Appeals, 842 S.W.2d 655, 657-58 (Tex. 1992) (holding that courts of appeals are authorized to issue orders to protect their jurisdiction over appeals brought under Texas Rule of Civil Procedure 76a); see also Oryon Techs., Inc. v. Marcus, 429 S.W.3d 762, 766-67 (Tex. App.- Dallas 2014, no pet.) (explaining that appellant's rights will not be adequately protected by supersedeas bond in most Rule 76a appeals and concluding that stay of trial court's order denying motion to seal records was necessary to preserve appellants' presumptive rights in documents during pendency of appeal of trial court's order).
