MEMORANDUM OPINION
By letter dated December 7, 2010, the Court notified appellant Randall Cunningham that his brief was overdue. We directed appellant to file his brief and extension motion within ten days, and we warned that failure to comply would result in the dismissal of the appeal without further notice. See Tex. R. App. P. 38.8(a)(1). To date, appellant has neither filed a brief nor communicated with the Court regarding the appeal. Accordingly, we dismiss the appeal.
