Before the Court is the appellant's January 2, 2003 agreed motion to dismiss appeal. The appellant asks that the appeal be dismissed because all matters in controversy between the parties have been settled. Appellee agrees to the motion. The agreed motion is GRANTED and the appeal is DISMISSED. Tex.R.App.P. 42.1(a)(1).
