Opinion

No. 05-07-00380-CV

Opinion Filed August 27, 2007.

On Appeal from County Court at Law No. 1, Dallas County, Texas, Trial Court Cause No. CC-07-02498-A.

Before Justices MOSELEY, O'NEILL, and FITZGERALD.

MEMORANDUM OPINION

On April 2, 2007, appellant filed a notice of appeal in this case. On the same day, we received verification that a contest to appellant's affidavit of indigence had been sustained. We notified appellant by letter that the $125 filing fee was due, and we gave appellant ten days to pay the filing. On May 21, 2007 and June 5, 2007, we directed appellant to file written verification, within ten days, that he had either paid or made arrangements to pay for the clerk's record. We warned appellant that if he failed to comply with our directives within the time allowed, the appeal was subject to dismissal without further notice. Nevertheless, to date, appellant has not paid the filing fee, and we have not received either the clerk's record or written verification that appellant has made payment arrangements for the record.

On the Court's own motion, we DISMISS the appeal. See Tex. R. App. P. 5, 42.3(c); Appendix to the Tex. R. App. P. (B)(1)(a).
