DAVID CAMDEN CHANCELLOR AND BRIAN YOUNG, ON BEHALF OF THEMSELVES AND ALL OTHERS SIMILARLY SITUATED, Appellants v. MISSION ESTATES PROPERTY OWNERS' ASSOCIATION, Appellee

On Appeal from the 385th District Court Midland County, Texas
Trial Court Cause No. CV50808

ORDER

The parties have filed in this court an agreed motion to abate this appeal and remand the cause to the trial court to effectuate settlement. In the motion, the parties indicate that they have reached a final settlement agreement that resolves the entire controversy, not just the interlocutory order that is the subject of this appeal. In accordance with the parties' request, we abate the appeal pursuant to TEX. R. APP. P. 42.1(a)(2)(C) so that the trial court and the parties may effectuate the parties' settlement agreement. So that we may properly dispose of this appeal in the future, the parties are directed to notify this court if the trial court enters any order that affects this appeal.

We grant the parties' agreed motion, abate the appeal, and remand the cause to the trial court.

PER CURIAM February 18, 2016 Panel consists of: Wright, C.J.,
Willson, J., and Bailey, J.
