ORDER

Upon consideration of respondent's motion to stay order to file certified index of record as defined in Bismullah v. Gates and to stay briefing schedule, the opposition thereto, and the reply; and the unopposed motion for leave to file surreply and the lodged surreply, it is.

ORDERED that the motion for leave to file be granted. The Clerk is directed to file the lodged surreply. It is.

FURTHER ORDERED that the motion to stay the schedule for filing the certified index and for briefing be granted in part and denied in part. Although the schedule entered August 24, 2007, for filing the certified index and for briefing will be suspended at the government's request, the court declines respondent's suggestion to stay indefinitely its obligation to file the certified index to the record; such action would be inconsistent with the court's order granting expedition of this petition. It is.

FURTHER ORDERED that respondent file a certified index to the record within 14 days of the court's disposition of the petition for rehearing en banc in Bismullah v. Gates, No. 06-1197.

Upon disposition of the rehearing petition inBismullah, the Clerk is directed to enter forthwith a briefing schedule and to calendar this case for oral argument on the first available date following the completion of briefing.
