MEMORANDUM OPINION
We reinstate this appeal. The parties have filed an Agreed Motion to Dismiss Appeal Pursuant to Settlement Agreement, stating they have entered into a settlement of this dispute that has now become final and requesting the Court to dismiss the appeal, with all costs and attorney's fees borne by the party that incurred them. Accordingly, we dismiss this appeal.
