Order

On order of the Court, the motion of plaintiffs to file a first amended complaint and a brief in support is GRANTED. The first amended complaint and supporting brief submitted on January 10, 2022, are accepted for filing. On further order of the Court, the motions of defendant for clarification and immediate consideration are GRANTED. The time period for filing defendant's answer began running when the first amended complaint and supporting brief were served in accordance with MCR 7.306(C)(3). Plaintiffs’ Certificate of Service indicates that the first amended complaint and brief were served on the chairperson of the Independent Citizens Redistricting Commission on January 10, 2022. The defendant's answer is therefore due within seven days of that date. MCR 7.306(D)(1). Because the seventh day falls on a Court holiday, the answer will be accepted as timely if filed the next business day, i.e., January 18, 2022. MCR 1.108(1). Defendant's request for a ten-day extension is DENIED.
