On Confession of Error


We treat the appellees' statements in their motion to remand as a confession of error. Pursuant thereto, the order of dismissal is reversed with directions to reinstate the independent action below. See DeClaire v. Yohanan, 453 So.2d 375 (Fla. 1984); Fla.R.Civ.P. 1.540(b).
