This case was calendared for trial at the the Court's December 13, 2021, Jacksonville, Florida remote trial session. On December 13, 2021, respondent filed a Motion to Dismiss for Failure to Properly Prosecute (Index #9). This case was called on December 13, 2021, and recalled on December14, 2021, at the Court's December 13, 2021, Jacksonville, Florida remote trial session. There was no appearance by or on behalf of petitioner. Counsel for respondent appeared before the Court and was heard. Respondent's Motion to Dismiss for Failure to Properly Prosecute filed December 13, 2021, (Index #9) was taken under consideration and the Court issued an order, served on December 21, 2021 and petitioner was directed to show cause in writing, on or before January 13, 2022, why respondent's Motion to Dismiss for Failure to Properly Prosecute should not be granted. On January 12, 2022, petitioner filed his written response to the Court's December 21, 2021 order.

Upon due consideration, it is

ORDERED that respondent's Motion to Dismiss for Failure to Properly Prosecute (Index #9) is hereby denied. It is further

ORDERED that, on or before March 25, 2022, the parties shall file with the Court either a proposed stipulated decision or joint status report regarding the then-present status of this case.
